Here on in Cab My Ride Limited may be referred to as "Us", "We", "Our", "Cab My Ride" and "CMR". Here on in Customer may be referred to as "You", "Riders", or "Customers". "Platform" our technology created to enable you to request a cab using our apps, phone booking, online booking, email booking, social media booking or any other form of communication you will use to book a cab.

Cab My Ride is a booking platform dedicated to providing an honest, safe and fair priced professional service by introducing registered drivers to customers who require their services.

Provision of Booking services

Cab My Ride provides you with certain booking services. The booking services include:

  1. Accepting bookings made by you, which included via the Cab My Ride App, Website Booking Form or Phone bookings. But without prejudice Cab My Ride reserves the right at its sole and absolute discretion to decline any such booking and/or cancel an accepted booking.

  2. Keeping records of booking

  3. Remotely monitoring bookings

  4. Receiving and dealing with feedback and complaints

  5. Manage lost property

Acceptance of terms & conditions

All customers are deemed to have read and accepted our terms of use and conditions. The terms of use and conditions extend to all passengers, companies or suppliers. By using our services you agree to abide by all applicable laws in force from time to time and any regulations set out by the company. Cab My Ride may amend these terms of use and conditions from time to time. If any part of these terms and conditions are found to be invalid or legally unenforceable by a court or tribunal then the rest of these terms and conditions shall continue to apply

Use of Cab My Rides’ services

Cab My Ride vets its self-employed drivers to ensure they are suitable and hold all necessary licences and qualifications. You accept, however, that Cab My Ride Ltd is not responsible for the conduct or behaviour of registered drivers nor is Cab My Ride responsible for any harm or damage caused to you by a self-employed driver. Customers who are unhappy with the service provided by a driver should contact us at the first possible opportunity with sufficient details to allow their complaint/grievance to be investigated thoroughly.
You can send an email to support@cabmyride.com. By using our services, customers undertake to defend Cab My Ride Ltd against any claim or legal proceeding against Cab My Ride Ltd by any person as a result of the customer's breach of any of Cab My Ride Ltd terms and conditions, as set out now or in the future.

Registration

You agree to give accurate information about yourself when using the Cab My Ride platforms, such as when you register for an account you further agree to keep such information up-to-date.

Right to cancel

All customers are deemed to have the right to cancel a trip. We may suspend your account if cancellations are regularly happening on your account Cab My Ride reserves the right to cancel a booking where it is reasonable to do so, such as where verbal or physical abuse is used or threatened against any of our registered drivers or members of staff. Cancellation Fee may apply where we feel applicable, such as you cancel the trip after the driver has arrived. This fee is ultimately down to Cab My Ride, and you will be notified when a cancellation fee will be applied.

The customer will be liable to pay for the full journey amount if the customer cancels within 24 hours of the pickup time for the journey.

Withdrawal of services

Cab My Ride reserves the right to terminate its services if any of the terms of use and conditions are breached, if you misuse any of the services provided to you or if you harm or attempt to harm the reputation or goodwill of Cab My Ride, if legal proceedings are brought against you or if you do not pay a court judgment awarded against you on time. Any Cab My Ride accounts that are subject to closure will allow for a seven day notice period being instigated by an email being sent to your registered email address. You agree that Cab My Ride reserves the right to restrict or suspend our services to you at any given time, without any notice whatsoever if we believe you have breached any of our terms and conditions.

Food, drink and tobacco

Consumption of food and drink is not permitted in vehicles booked through Cab My Ride. Smoking and the consumption of illegal substances is prohibited in vehicles booked via Cab My Ride Ltd. Intoxicated persons may be refused carriage, and the booking is liable for cancellation.

Damage to vehicle

You are responsible for the cost of repair for damage to, or necessary cleaning of the drivers' vehicle and property resulting from use of the services under your account in excess of normal wear and tear, damages and essential cleaning known as "Repair or Cleaning". In the event, that driver provides a report in need for Repair or Cleaning. Cab My Ride approves such Repair or Cleaning request in our reasonable discretion, we reserve the right to facilitate payment for the reasonable cost of such Repair or Clean on behalf of the driver using your payment method designated in your account. Such amounts will be transferred by Cab my Ride to the applicable driver and are non-refundable.

Travelling with children

The law allows for specific exceptions when travelling in a licensed taxi or private hire vehicle when a child seat is not available. Despite this, it is the joint responsibility of the driver and the parent/guardian to ensure that the child is safely restrained for the duration of the journey. Children under 16 must be accompanied by an adult unless by prior agreement. When booking via our contact centres they will not advise on child seat or other transportation needs, and it is up to you to provide your equipment.

Luggage

Luggage is limited to the maximum weight capacity of the vehicle. You must inform Cab My Ride beforehand if you believe your luggage may exceed the maximum weight capacity. Care is taken when handling customer luggage, although customers are advised to label their property. All customer property is carried at the customer’s risk, and Cab My Ride Ltd accepts no responsibility for loss or damage suffered.

Lost Property

If you lose your luggage or your personal belongings you must raise this with your driver immediately. Cab My Ride Ltd accepts no responsibility for lost or damaged luggage. You can file a lost property report by emailing us: support@cabmyride.com. If you have the trip ID or booking reference add that to your email or phone call.

Unforeseen Circumstances

Cab My Ride accepts no responsibility for events beyond our control which affect your journey or our ability to provide you with services you would otherwise reasonably expect of us. Such activities include (but are not limited to) war or the threat of war, riots, civil unrest, strikes, industrial action, acts of terrorism, natural disaster, fire, unforeseen technical problems, road closure or adverse weather conditions. Cab My Ride accepts no responsibility for any additional costs which may be incurred by you under such circumstances, such as loss of earnings or unforeseen expenditure. Customers are responsible for ensuring they book a taxi through Cab My Ride in a manner which allows them to reach their intended destination on time. Cab My Ride will not accept responsibility or liability for actions or events outside of its control which result in the customer reaching their destination late.

NOTE: All our services are subject to availability. There may be times when, due to demand or unforeseen circumstances beyond our control, our ability to provide transport takes longer than usual. Under these circumstances, we will endeavour to provide you with transportation which may involve us using a vehicle or vehicles which are not your first choice of transport.

Our liability

The material displayed on our site and in our smartphone app is provided without any guarantees, conditions or warranties as to its accuracy. To the extent permitted by law, we hereby expressly exclude all conditions, warranties and other terms, which might otherwise be implied by statute, common law or the law of equity. Any liability for any direct, indirect or consequential loss or damage incurred by any user in connection with our site or connection with the use, inability to use, or results of the use of our site, any websites linked to it and any materials posted on it, including loss of income or revenue; loss of business; loss of profits or contracts; loss of anticipated savings; loss of data; loss of goodwill; wasted management or office time; and whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable. This does not affect our liability for death or personal injury arising from our negligence, nor our liability for fraudulent misrepresentation or misrepresentation as to a fundamental matter, nor any other liability which cannot be excluded or limited under applicable law. 15. Vehicles Cab My Ride Ltd cannot guarantee that any particular type of vehicle used will be used for a specific booking. It may be necessary for an alternative vehicle to be utilised.

Liability

Cab My Ride accepts no liability for any loss or damage, save as provided for by law. The Contracts are made between Customers and registered Drivers and any liability will arise on the part of the registered driver.

Seat belts

Cab My Ride is committed to the safety of its customers and passenger seat belts must be worn at all times when travelling, in accordance with the law. We reserves the right to cancel a booking where a customer refuses to wear a seat belt without a lawful excuse.

Payment

You understand that use of services may result in charges to you for the services or good you receive from a driver. After you have received services or goods obtained through your use of the service, Cab My Ride will facilitate your payment of the applicable charge on behalf of the driver as disclosed payment collection agent for the driver. Payment of the Charges in such manner shall be considered the same as a payment made directly by you to the driver. Chargers will be inclusive of applicable taxes and VAT where required by law. Charges paid by you are final and non-refundable unless otherwise determined by Cab My Ride. You retain the right to request lower Charges from a driver for services or goods received by you from such driver at the time you receive such service or products. Cab My Ride will respond accordingly to any request from a driver to modify the charges for particular service or good. All charges are due immediately and payment will be facilitated as soon as practicable by Cab My Ride using the preferred payment method designated in your Account, after which Cab My Ride will send you a receipt by email or paper or SMS message. Please note that this payment for the booking, is not final or fixed, your fare may increase or be lowered once the trip has been carried out by the driver or supplier.
If your primary payment method is determined to be expired, invalid, insufficient fund or otherwise not able to be charged, you agree that Cab My Ride may, as the driver disclosed payment collection agent, use a secondary payment method in your Account if available. If not, you will pay your driver cash payment.

As between you and Cab My Ride, we reserve the right to establish, remove and revise charges for any or all services or goods obtained through the use of the services at any time in Cab My Rides' sole discretion. Further, you acknowledged Cab My Ride may from time to time provide certain users with promotional offers and discounts that may result in different amounts charged for the same or similar services or goods obtained through the use of the services. You agree that such promotional offers and discount unless also made available to you, shall have no bearing on your use of services or the charges applied to you. You may elect to cancel your request for services or goods from a driver at any time before such driver's arrival, in which case you may be charged a cancellation fee. This payment structure is intended to compensate the driver for the services or goods provided fully. Except with respect to taxicab transportation services requested in some jurisdiction, Cab My Ride does not designate any portion of your payment as a tip or gratuity to the driver. Any representation by Cab My Ride to the effect that tip is "voluntary", "not required", and "included" in the payment you make for service or goods provided is not intended to suggest that Cab My Ride provides any additional amounts, beyond those described above, to the driver. You understand and agree that, while you are free to provide additional payment as a gratuity to any driver who provides you with services or goods obtained through the service, you are under no obligation to do so. Gratuities are voluntary after you have received services or products obtained through Cab My Ride you will have the opportunity to rate your experience and leave additional feedback about your driver. Pre-Authorize payment will happen when you use Cab My Ride and paying by card, Cab My Ride as the payment processor on behalf of a driver will hold these funds until the trip is completed or cancelled, these funds will be taken away from your available funds and may be more than your fare estimate. Cab My Ride uses payment systems provided by Stripe (website:https://stripe.com/gb) and also SumUp (website:https://sumup.co.uk/) full details on how Stripe and SumUp hand your card information can be found on their website.

Promotional Codes & Discounts

From time to time Cab My Ride may, in Cab My Ride's sole discretion, create promotional codes that may be redeemed for account credit, or other features or benefits related to the service and or a third-party provider's services or goods, subject to any additional terms that Cab My Ride establishes on a per promotional code basis "Promo Codes", "Gifts" or "Rewards". You agree that promotional codes must be used for the intended audience and purpose, and lawfully, may not be duplicated, sold or transferred in any manner, or made available to the general public whether posted to a public forum or otherwise, unless expressly permitted by Cab My Ride. Cab My Ride may disable a promotional code at any time for any reason without liability to Cab My Ride, may only be used pursuant to the specific terms that Cab My Ride establishes for such Promotional Code. Promotional Codes are not valid for cash and may expire prior to your use. Cab My Ride reserves the right to withhold or deduct credits or other feature or benefits obtained through the use of Promotional codes by you or any other user in the event that Cab My Ride determines or believes that the use or redemption of the promotional code was in error, fraudulent, illegal, or in violation of the applicable promotional code terms of these terms. Promotional Codes can only be redeemed via the Cab My Ride app and on card payment trips only, trips where the customer is paying by Cash, Chip and Pin (Card in Cab) or account, promotional codes will not apply to the service or good you receive.

First two rides on us!*

Cab My Ride will give you your first two rides on us up to the value of £5 for each ride. Any trip over £5 the customer will have to pay the difference in fare. So your £10 ride will only cost you £5.
This promotion is only available to new customers only via the Cab My Ride app. New Email address and contract number required on registration. Promotion is subject to availability and Cab My Ride reserve the rights to cancel the promotion without any notice. The promotion ends 18th June 2021.

Complaints

At Aryvo, we strive to provide excellent service, and we regret any inconvenience or dissatisfaction you may have experienced during your ride. Your feedback is essential to our continuous improvement. Submitting Your Complaint To make a complaint, please follow these steps:
Clearly outline the details of your experience and the areas where you feel we fell short. Be specific and provide relevant information. Send your complaint in writing to support@aryvo.com. Ensure you include the following details
 - Your full name
 - Date and time of the ride
 - Booking reference number (if available)
 - Description of the issue, including any relevant screenshots.
We kindly request that you submit your complaint within 28 days of the ride taking place. This allows us to address the issue promptly and effectively.

Collection

Customer bookings are liable for cancellation if the customer fails to make themselves available at the pick-up point at the agreed time. As a customer, it is your obligation to make yourself readily available from the pick-up point requested upon booking. If you are found to be providing Cab My Ride with false information regarding your booking, e.g. pick up point, the number of passengers or general misconduct of the service on a repeated basis then we may terminate your ability to use our service. Once you have received notification of the cab waiting outside of the pick-up point, you are advised to make contact with the driver at the earliest opportunity within the 5 minutes waiting time. The driver will do there utmost to contact you within the 5 minutes waiting time. However, the driver will contact you one last time after the 5 minutes waiting time has expired, before they cancel your booking request if no contact has been made by you, the customer with the driver.

Use of software and web services

Access to our site and smartphone app is permitted on the basis that we reserve the right to withdraw or amend the services we provide via our site and smartphone app without notice. We will not be liable if for any reason our site is unavailable, or our smartphone app is not functional at any time or for any period. From time to time, we may restrict access to some parts of our site, or our entire site, to users who have registered with us. If you choose, or you are provided with, a user identification code, password or any other piece of information as part of our security procedures, you must treat such information as confidential, and you must not disclose it to any third party. We have the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time, if in our opinion you have failed to comply with any of the provisions of these terms of use. You are also responsible for ensuring that all persons who access our site through your internet connection are aware of these terms and that they comply with them. You must not misuse our site or smartphone app by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to our site, the server on which our site is stored or any server, computer or database connected to our website. You must not attack our site via a denial-of-service attack or a distributed denial-of-service attack. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities, and we will cooperate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our site will cease immediately. We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our site or to your downloading of any material posted on it, or on any website linked to it. You agree not to upload content to Cab My Ride Ltd’s website which is unlawful, offensive, obscene, harassing, threatening, abusive, defamatory, slanderous, pornographic or violates any intellectual property rights or rights to privacy of any third party or group. You agree not to upload any material which could be deemed offensive on the basis of gender, race, age, disability, or religion. You agree not to promote your own products or services or those of any third party. Cab My Ride Ltd reserves the right to monitor any uploaded content at any time, in any form whatsoever.

Text Messaging known as (SMS)

By creating an account, or using Cab My Rides services and platforms, you agree that the service may send you text messages as part of the standard business operations of you use of the services. You may opt out of marketing messages however this will impact your use of the services and missing importation notifications about your account, security and delivery of services of goods.

Linking to our website

You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it. Still, you must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists. You must not establish a relationship from any website that is not owned by you. Our website must not be framed on any other site, nor may you create a link to any part of our site other than the home page. We reserve the right to withdraw linking permission without notice. If you wish to make any use of material on our site other than that set out above, please contact us with the relevant details.

Linking from our website

Where our website contains links to other sites and resources provided by third parties, these links are provided for your information only. We have no control over the contents of those sites or resources, and accept no responsibility for them or for any loss or damage that may arise from your use of them.

Intellectual property rights

We are the owner of all intellectual property rights in our site and smartphone app and in the material published therein. Those works are protected by copyright laws and treaties around the world. All such rights are reserved. You may print off one copy and may download extracts, of any page(s) from our site for your reference, and you may draw the attention of others within your organisation to material posted on our website, social media, marketing, app design or any other part of the Cab My Ride Business. You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, text, communications, video or audio sequences or any graphics separately from any accompanying text. Our status as the authors of material on our site must always be acknowledged. You must not use any part of the materials on our website for commercial purposes without obtaining a licence to do so from us beforehand. If you print off, copy or download any part of our site in breach of these terms of use, your right to use our site will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.

Variation

We may revise these terms of use at any time by amending this page. You are expected to check this page from time to time to take notice of any changes we made, as they are binding on you. Some of the provisions contained in these terms of use may also be superseded by provisions or notices published elsewhere on our site.

Jurisdiction

All disputes that cannot be settled amicably between the customer and Cab My Ride Ltd will be subject to exclusive jurisdiction of the courts of England and Wales.
